Can British citizens still buy in Spain post-Brexit? Yes! Brexit has not affected the right of UK citizens to purchase property in Spain. However, UK citizens are now limited to staying 90 days in any 180-day period without a residence visa.

The Buying Process

  1. Obtain an NIE Number: Required for all property transactions (Foreigner Identity Number)
  2. Open a Spanish Bank Account: Needed for utility payments and tax obligations
  3. Reserve the Property: Typically 3,000-10,000€ deposit
  4. Sign Private Contract: Usually 10% deposit, property removed from market
  5. Complete Due Diligence: Legal checks on property and land registry
  6. Sign Public Deed: At notary, remainder paid, ownership transfers

Costs & Taxes

  • Purchase Tax: 6-10% transfer tax (ITP) on resale properties, or 10% VAT + 1.5% stamp duty on new builds
  • Legal Fees: Approximately 1% of purchase price
  • Notary & Registry: Around 1-2% of purchase price
  • Annual Property Tax (IBI): 0.4-1.1% of rateable value
  • Community Fees: Varies widely by development

Mortgages

Spanish banks offer mortgages to non-residents, typically up to 60-70% loan-to-value. Interest rates are generally higher for non-residents, and proof of income from UK sources is required.
